Terms of Service

These terms are an agreement between you and BDA Technologies Private Limited (“BDA”, “we”, “us”) for the use of HireAssist, the hiring platform at hireassist.org and app.hireassist.org. By creating an organisation, accepting an invitation to one, applying through a HireAssist career page or otherwise using the service, you agree to them. If you are accepting on behalf of a company, you confirm you are authorised to bind it.

1. The service

HireAssist gives employers a branded career page, a public job board, AI-assisted resume screening, auto-graded skills quizzes, asynchronous video interviews, interview booking, a candidate pipeline, team accounts and related tools. We may add, change or retire features over time. We will give reasonable notice before removing a feature that paid organisations rely on.

2. Accounts and organisations

  • You must give accurate information when you create an organisation and keep it current.
  • You are responsible for everything done under your organisation, including by team members you invite. Keep sign-in credentials confidential and tell us promptly about any unauthorised use.
  • Administrators can add and remove team members and assign roles. BDA is not responsible for disputes between members of the same organisation.
  • You must be at least 18 years old to create or join an organisation.

3. Credits, packs and payment

  • HireAssist has no subscription. Actions such as screening a resume, publishing a job or sending a quiz invite each cost a fixed number of credits. The current price of each action is shown in the product and on hireassist.org/#pricing.
  • New organisations receive 100 free credits that expire 30 days after signup. Credits in paid packs do not expire while the organisation remains active.
  • Credit packs are bought in advance through Chargebee. Prices are in Indian rupees and exclude GST, which is added at checkout at the applicable rate. You agree to give accurate GST details for invoicing.
  • Credits are deducted when an action is started. Where an action fails because of a fault on our side, we restore the credits.
  • Credits have no cash value, cannot be transferred between organisations and cannot be resold. Refunds are handled under our refund and cancellation policy.
  • We may change pack prices and per-action credit costs. Changes do not affect credits you already hold, and we will announce price changes in the product before they take effect.

4. Your content and candidate data

  • You own the job descriptions, questions, templates, notes and other content you put into HireAssist, and the applications your candidates submit to you. You give us the licence needed to host, process, display and transmit that content to run the service for you.
  • You are the data fiduciary for your candidates’ personal data. You are responsible for having a lawful basis to collect it, for telling candidates how you use it, for responding to their requests and for keeping it only as long as you need it. We process candidate data on your instructions as described in our privacy policy.
  • You must not upload content that you do not have the right to use, that is unlawful, defamatory or discriminatory, or that infringes anyone’s rights.

5. AI features and hiring decisions

Resume scores, quiz grades, transcripts, evaluations and summaries are generated by AI models and can be wrong, incomplete or biased. They are an aid to your judgement, not a substitute for it. You remain responsible for every hiring decision, for reviewing automated results before acting on them, for setting thresholds that are appropriate for your role, and for complying with the employment, anti-discrimination and data protection laws that apply to you. HireAssist does not make hiring decisions and does not guarantee the accuracy of any score.

6. Acceptable use

You must not use HireAssist to:

  • post jobs that do not exist, collect applications for any purpose other than hiring, or charge candidates to apply;
  • discriminate against candidates on grounds prohibited by law, or configure the service to do so;
  • send unsolicited bulk email, harass anyone, or impersonate another person or company;
  • upload malware, probe or disrupt our systems, scrape the service, or try to access another organisation’s data;
  • reverse engineer the service, or use it to build a competing product;
  • exceed reasonable usage limits that we set to keep the service working for everyone.

We may suspend or close an organisation that breaks these rules. Where practical we will warn you first.

7. Candidates

If you apply through a HireAssist career page, your application goes to the employer who posted the job, who decides how to handle it. HireAssist lets you track your status through a link, open a dashboard through a magic link, take quizzes, record video answers and book interviews. You confirm that what you submit is true and your own work, and that you have the right to share any recording you make. Questions about a specific job or decision should go to that employer.

8. Third-party services

Some features depend on third parties: Chargebee for payments, Google for Calendar and Meet when you connect them, your own mailbox for reply tracking, and AI model providers for parsing, scoring and transcription. Their terms apply to your use of their services, and we are not responsible for their availability or conduct.

9. Availability and support

We aim to keep HireAssist available at all times but do not guarantee uninterrupted service. We may take the service down for maintenance, preferably with notice. Support is available by email at Info@bdatechnologies.com and through the help pages in the product.

10. Intellectual property

HireAssist, its software, design, trademarks and documentation belong to BDA. These terms do not give you any right to them beyond using the service. You may use the HireAssist name only to identify that your career page is hosted on HireAssist.

11. Ending the agreement

  • You can stop using HireAssist and close your organisation at any time from the account settings or by emailing us. Unused paid credits are handled under the refund and cancellation policy.
  • We can suspend or end your access if you breach these terms, do not pay amounts due, or if continuing would expose us or others to legal risk.
  • After closure we delete your data as described in the privacy policy. Export anything you need, including the Excel export of candidates, before closing.

12. Disclaimers and limits on liability

HireAssist is provided “as is”. To the extent the law allows, we exclude all implied warranties, including fitness for a particular purpose, and we are not liable for indirect or consequential loss, lost profits, lost hires or lost data. Our total liability to you for any claim arising from the service is limited to the amount you paid us for credits in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited under Indian law.

13. Indemnity

You will indemnify BDA against claims, losses and costs arising from your content, your use of candidate data, your hiring decisions or your breach of these terms.

14. Governing law and disputes

These terms are governed by the laws of India. The courts having jurisdiction over the registered office of BDA Technologies Private Limited have exclusive jurisdiction over any dispute, after the parties have first tried in good faith to resolve it by discussion for at least 30 days.

15. Changes

We may update these terms. We will post the new version at hireassist.org/terms, update the effective date and, for material changes, notify organisations in the product or by email at least 15 days before they take effect. Continuing to use HireAssist after that date means you accept the new terms.
